Categories of data
As a rule, this website can be used without the provision of personal data. In those cases where personal data (e.g. name, address or e-mail address) is collected on our website, this data is, where possible, always provided voluntarily. This data will not be passed on to third parties without your explicit consent. Please note that the transfer of data on the Internet (e.g. during e-mail communication) may not always be 100% secure. It is not possible to guarantee complete protection of data from third-party access.

a) Cookies

Data collection and data use
We collect and process your personal data

a) to perform contractual obligations (Article 6(1)(b) GDPR)
We collect personal data when you send us an e-mail, contact form or order form, register for and use our online services, apply to become a member of the FGSV, or state your willingness to work in one of our committees, working groups or bodies. In these cases, we only collect the

  • master data (e.g. names, addresses),
  • contact data (e.g. e-mail addresses, telephone numbers),
  • content data (e.g. text entered, photos, videos),
  • usage data (e.g. websites visited, interest in content, access times), and
  • metadata/communication data (e.g. device information, IP addresses),

that is required to answer your query, process your application or provide our online services. We use the data you provide to fulfil the contract and process your queries.

b) to balance interests (Article 6(1)(f) GDPR)
We use the data provided by you above and beyond the fulfilment of the contract to pursue our legitimate interests or those of a third party, in particular

  • for purposes covered by our statutes relating to membership of the association, especially regarding the publication of directories that list members of the association and members of its committees, working groups and other bodies, technical standards and specifications and other documents;
  • for the collaboration of members, experts, authors and consultants;
  • for the establishment of legal claims;
  • to ensure IT security especially for the purposes of access control.

c) on the basis of your consent (Article 6(1)(a) GDPR)
If you consent to the processing of your personal data for specific purposes (e.g. because you would like to receive a newsletter), the lawfulness of the processing of data is assured by your consent. You can withdraw your consent at any time. Please note that the withdrawal of consent can only apply to the future. Data that was processed prior to the withdrawal of consent is not affected by that withdrawal.

Recipients of personal data
FGSV e.V. and FGSV Verlag GmbH are bound by the same data protection guideline. Within FGSV e.V. and FGSV Verlag GmbH, those units that need access to your data in order to fulfil our contractual and legal obligations or in order to balance interests get access to your data. Any service providers and agents working for us can also be given data for these purposes as long as they observe our data protection rules and undertake to respect data confidentiality.
 
Duration of the storage of personal data
The duration of the storage of your data depends on the cessation of the purpose for which it was processed. If the data is no longer necessary to fulfil this purpose, the data is deleted on a regular basis unless its – limited – processing is necessary for the fulfilment of commercial and fiscal retention periods such as those stipulated in the German Commercial Code and German Fiscal Code.
 
Rights of the data subject
You have the right of access in accordance with Article 15 GDPR, the right to rectification in accordance with Article 16 GDPR, the right to erasure in accordance with Article 17 GDPR, the right to restriction of processing in accordance with Article 18 GDPR, the right to object in accordance with Article 21 GDPR, and the right to data portability in accordance with Article 20 GDPR. You also have the right to lodge a complaint with a supervisory authority (Article 77 GDPR in conjunction with Section 19 of the German Data Protection Law (BDSG)).
You can withdraw your consent to the processing of personal data at any time. Please note that the withdrawal of consent can only apply to the future. Data that was processed prior to the withdrawal of consent is not affected by that withdrawal.

Provision of personal data
Within the context of our business relationship and the provision of services such as the processing of your membership application, the answering of your queries or the use of online services, we only need the personal data that is necessary for the performance of our business relationship or the provision of a service and the fulfilment of associated contractual obligations or that we are legally bound to collect. Without this data, we cannot take any action on your request.
Data is only transferred to countries outside the EU or the EEA when it is necessary to do so for the delivery of goods and services to a recipient in a third country.
 
Information on your right to object in accordance with Article 21 GDPR
a) The right to object with regard to an individual case
You have the right to object, on grounds relating to your particular situation, to the processing of personal data concerning you. This right is based on point (f) of Article 6(1) GDPR  (processing for the purposes of the pursual of legitimate interests) or on point (e) of Article 6(1) GDPR  (processing for the performance of a task carried out in the public interest). This also includes profiling based on those provisions. If you raise such an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing of that data which override your interests, rights and freedoms or your personal data is needed for the establishment, exercise or defence of legal claims. 

b) The right to object to the processing of your data for direct marketing
Where personal data is processed for the purposes of direct marketing, you have the right to object to such processing at any time. This also includes profiling to the extent that it relates to such direct marketing. If you raise such an objection, we will no longer process your personal data for the purposes of direct marketing. No specific form must be observed when raising an objection. Where possible, please use the address(es) given above to contact our data protection officer.
 
The security of your data
For security reasons and in order to secure the transfer of confidential information such as queries you send us as the provider of this website, this website uses SSL encryption. You can tell when an encrypted connection is being used when the 'http://' changes to 'https://' and a padlock symbol appears in your browser's address bar. When SSL encryption is activated, the data you send us cannot be read by third parties.
 
Newsletter
You can sign up for our newsletter on our website. To do so, simply enter your e-mail address and tick the box to confirm that you would like to receive the relevant newsletter. On the basis of this consent, we will process your e-mail address solely for the purpose of sending you the relevant newsletter. The legal basis for the processing of data in this way is provided by point (a) of Article 6(1) GDPR. You can withdraw your consent free of charge and at any time without any explanation. You can also exercise your right to withdraw your consent by clicking on the relevant link that is included at the end of every newsletter. We will save the e-mail address you provided during registration until you withdraw your consent. Data that is stored by us for other purposes is not affected by this withdrawal of consent.

Web analysis through Matomo
With your consent, we use the open-source software Matomo to analyse and statistically evaluate the use of the website. Cookies are used for this purpose. Matomo does not transmit any data to servers that are outside the control of the FGSV. Without your consent, Matomo does not collect any session data. 

The information obtained about the website usage is summarised in pseudonymous usage profiles. We use the data to analyse the use of the website. The data collected is not passed on to third parties.
The IP addresses are anonymised (IP masking) so that they cannot be assigned to individual users.

The data is processed based on Art. 6 para. 1 sentence 1 lit. a GDPR. In doing so, we are pursuing our legitimate interest in optimising our website for our external presentation.
